Terms of Service

These Terms of Service (“Terms”) govern your use of bluds.shop and any purchase you make from it. The site is operated by Bluds LLC (“Bluds”, “we”, “us”), a limited liability company registered in New Mexico, United States.

By using this site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

Who may use the site

You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to place an order. By ordering you confirm you can enter a binding contract. We currently sell and ship to addresses within the United States only.

Your account

You do not need an account to buy from us. If you create one, keep your password confidential and tell us promptly if you suspect unauthorised use. You are responsible for activity under your account. We may suspend or close an account that is being used in breach of these Terms.

Products and descriptions

We try to describe and picture products accurately. Colours can vary between screens, and packaging and minor details may change between production batches. Product images are illustrative. Where an item differs materially from its description, our Return and Refund Policy applies.

All products are subject to availability. We may change or discontinue any product at any time, and may limit the quantity available to any one customer or order.

Prices and errors

Prices are shown in United States dollars and may change without notice. Applicable sales tax is calculated and shown at checkout. Shipping is free.

Despite our efforts, a product may occasionally be listed at an incorrect price or with incorrect information. Where an order is affected by an obvious error, we may cancel it and refund you in full, even after the order has been confirmed. We will contact you if this happens.

Orders

Your order is an offer to buy. The confirmation email we send when you check out acknowledges that we received your order; it does not by itself form a contract. The contract is formed when we dispatch the goods.

We may refuse or cancel any order, including where the item is unavailable, where we cannot ship to the address given, where the order appears fraudulent or is placed for resale, or where a pricing or description error applies. If we cancel an order you have paid for, you get a full refund.

Payment

Payment is taken at checkout through our payment providers. You confirm that you are authorised to use the payment method you provide. We do not store full card details. If a payment is reversed or charged back without cause, we may recover the amount owed and suspend further orders.

Shipping, returns and cancellation

Delivery is governed by our Shipping Policy. Returns, refunds and order cancellation are governed by our Return and Refund Policy. Both form part of these Terms.

Risk of loss passes to you when the carrier delivers the parcel to the address you gave us.

Acceptable use

You agree not to use the site for any unlawful purpose, to interfere with its operation or security, to attempt to gain unauthorised access to any part of it, to scrape or harvest data by automated means without our written permission, to submit false information, or to infringe anyone’s rights.

Reviews and other content you submit

If you post a review or other content, you confirm it is your own, honest, and not unlawful, defamatory, obscene or infringing. You grant us a non-exclusive, royalty-free, worldwide licence to use, display and reproduce that content in connection with our business. We may edit or remove content that breaches these Terms, but we are not obliged to monitor submissions.

Intellectual property

The site, its design, text, graphics, logos and the Bluds name are owned by Bluds LLC or its licensors and are protected by intellectual property law. You may not copy, reproduce or reuse them without our written permission. Product names and brands belonging to third parties remain the property of their owners.

Third-party links

The site may link to services we do not control. We are not responsible for their content, products or practices, and linking does not imply endorsement.

Disclaimer of warranties

Except where the law says otherwise, the site and the products are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or secure.

Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here removes rights you have under applicable consumer protection law.

Limitation of liability

To the fullest extent permitted by law, Bluds LLC and its officers, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site or any product bought through it.

Where liability cannot be excluded, our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.

Indemnity

You agree to indemnify and hold Bluds LLC harmless from claims, losses and reasonable legal costs arising from your breach of these Terms or your misuse of the site.

Governing law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law rules. You and we agree that the state and federal courts located in Bernalillo County, New Mexico have jurisdiction over any dispute, subject to any right you have to bring a claim in your local small claims court.

If part of these Terms cannot be enforced

If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.

Changes to these Terms

We may update these Terms. The revision date at the top shows when they last changed. The Terms in force when you place an order are the ones that apply to that order.
